As the whiplash capital of Europe, it's not surprising that whiplash claims just on their own are costing a large part of any insurance premium. Anything from £40-£60 (depending on who you ask) is the figure whiplash claims are costing you as an honest policyholder.
Why so much? Whiplash claims are "easy" to get through as the symptoms are always expected after a car crash, but often unprovable. In nearly all cases the claimant simply visit's their own doctor or local emergency room who rely on the claimants own description of the injuries and pain to make a diagnosis. In other words, if the patient says "my neck hurts" - the hospital staff write down "whiplash".
Proving there is, or was, no actual injury or pain is problematic to say the least for the insurance company and they often just pay out. At £200-£300 an hour in legal costs, the £1500-£2000 whiplash claim seems like peanuts.
So there you have it. Without a decent medical system in place to efficiently (and cheaply, this is the NHS after all) diagnose whiplash, insurers are always going to pay out.
This, however, is not the most shocking part of our ever-claiming culture. Quite often, the legal fees for pursuing the claim outway the actual compensation payout! The solicitor running the case can receive upward of £3000 in legal costs from the losing third party, whilst the claimant -- the injured one who was apparently suffering -- will receive under £3000 in most cases.
Whilst clamping down on fake whiplash claimants may seem an impossible feat, surely capping legal costs is a far easier move to bring down the cost of insurance premiums in the UK?
